1. Broker Fee Responsibility
Under the new law, prospective tenants cannot be required to pay a broker’s fee unless they have independently chosen to hire a licensed real estate broker or salesperson and have executed a written agreement for those services.
If a landlord, property owner, property manager, or their representative engages a broker to market or lease a rental unit, the landlord or property owner is responsible for paying that broker’s fee, not the tenant.
2. Written Agreement Requirement
Any broker fee may only be charged to the party who has personally retained the broker in writing. No tenant may be charged a broker fee based on advertisements, implied obligations, or the actions of a broker hired by another party.
