Massachusetts Broker Fee Disclosure
M.G.L. c. 112, § 87DDD½ – Real Estate Brokers and Salespersons“A licensed broker or salesperson may solely contract with a prospective tenant to find rental residential real property for a tenant and present an offer to lease to the landlord or landlord’s agent and negotiate on behalf of the tenant or may solely contract with a landlord or landlord’s agent to find a tenant for a property. Any fee shall only be paid by the party, lessor or tenant who originally engaged and entered into a contract with the licensed broker or salesperson.”
In accordance with the Massachusetts law taking effect on August 1, 2025, we provide the following disclosure regarding broker fees and leasing practices:
1. Broker Fee Responsibility
Under the new law, prospective tenants cannot be required to pay a broker’s fee unless they have independently chosen to hire a licensed real estate broker or salesperson and have executed a written agreement for those services.
If a landlord, property owner, property manager, or their representative engages a broker to market or lease a rental unit, the landlord or property owner is responsible for paying that broker’s fee, not the tenant.
2. Written Agreement Requirement
Any broker fee may only be charged to the party who has personally retained the broker in writing. No tenant may be charged a broker fee based on advertisements, implied obligations, or the actions of a broker hired by another party.
3. No Mandatory Broker Fees to Tenants
We do not require tenants to pay a broker fee unless the tenant has formally and voluntarily entered into a written agreement with a broker of their choosing.
Listings, applications, and lease agreements will not contain language requiring tenants to pay a broker fee for services they did not directly contract for.
4. Commitment to Transparency and Compliance
Our company adheres to all state requirements concerning rental fee transparency and consumer protection. All mandatory charges, fees, and obligations associated with renting a unit will be disclosed clearly, honestly, and in compliance with Massachusetts law.
